In state court, both sides to an appeal may be ordered to attend a formal settlement conference before they are allowed to file briefs. If the parties can settle the matter, both sides win and the parties will save money.
Child custody appeals use the fast track system, where the case is usually decided within 5 months of the settlement conference. All other civil appeals, including all other Family Court matters, use the traditional method, which can take over a year from the settlement conference for a decision.
The most important thing about an appeal is timing. The deadline for filing an appeal or other post-trial relief can be as little as 10 days.
